ABOUT THE ROLE

Class Action Attorney, New York

A class action is the one procedure built for harm that is too small to sue over alone and too widespread to ignore. It is also the procedure our users are least likely to ever reach. They are self-represented, they are handling one case, and nobody is looking across their case and the four hundred that look exactly like it.
We are. People come to ProPera Legal with landlords who charge the same illegal fee, employers who round the same hours down, and agencies that deny the same benefit for the same wrong reason. The pattern is visible from where we sit and invisible from where they sit. This role is what we do about it.
New York is where it starts, and the reason is jurisdictional rather than sentimental. It is the venue where the most of this work already lives, it has both a serious federal bench and CPLR Article 9 for state claims, and a lawyer who can carry a certification motion through either one can reach the most people fastest.
You practice in your own name, under your own license, with your own professional judgment. What we bring is the pattern, the underlying records, and the litigants who lived it.
What you would do
◆
Evaluate potential class claims, including patterns we surface from what self-represented litigants are already filing
◆
Draft and argue certification motions under FRCP 23 and under CPLR Article 9
◆
Build the record certification actually turns on: numerosity, commonality, typicality, adequacy, and predominance
◆
Serve as class counsel, or work alongside the firm that does
◆
Take individual retainers where a claim is better off outside a class
◆
Manage discovery at class scale, including e-discovery volume and expert work
◆
Tell us what a class claim needs from the platform that it is not getting today
What we are looking for
◆
An active license in good standing with a New York bar, and admission to the Southern or Eastern District of New York or a willingness to seek it
◆
At least five years practicing law
◆
Real class certification experience: classes you have certified, or substantial work on the certification motions that got there
◆
Working command of FRCP 23 and CPLR Article 9, and the ability to explain to a lay client what each of them requires
◆
Consumer, wage and hour, housing, or civil rights subject matter, or another area where the harm is small per person and large in total
◆
Your own professional liability coverage
◆
The judgment to tell a would-be class representative honestly when their claim is not one
Nice to have
◆
Appellate experience on a certification order, in the Second Circuit or the Appellate Division
◆
Experience with settlement approval, notice programs, and claims administration
◆
A meaningful pro bono or legal aid history
◆
Spanish fluency
◆
Admission in more than one state. We expect to open roles beyond New York
What you get
◆
You set your own rate. We do not cap it and we do not set it for you
◆
You choose which matters you take and how many hours you work
◆
Fully remote, on your own schedule
◆
Claim patterns drawn from what people are actually filing, not from a lead list
◆
Case files that arrive organized, with a drafting and formatting engine built for court filings
◆
A direct line to the people building the product
WHAT THIS ROLE IS NOT

Read this part twice.

◆
ProPera Legal is not a law firm and does not practice law.
◆
You exercise your own independent professional judgment on every matter, including whether a claim belongs in a class at all. Nobody here directs it.
◆
The attorney client relationship is between you and your client.
◆
We surface patterns and make introductions. We do not screen claims, evaluate merits, or offer anyone an opinion about their case.
◆
You remain responsible for conflicts checks, trust accounting, client confidentiality, and compliance with the New York Rules of Professional Conduct, including the advertising and solicitation rules.
This is the only class action posting we have open. If you do this work and are admitted somewhere other than New York, write to us anyway and say which state, because the patterns are not confined to one.
